  47. 1. DEFINITIONS
  48.  
  49. "jv16 PowerTools 2008" means the jv16 PowerTools 2008 software product
  50.   and everything included in its official distribution
  51.   packages, such as the documentation, all the plug-in
  52.   applications and all the other such modules and applications.
  53.  
  54. "Trial version" means the free, unlicensed and time limited 
  55.   edition of jv16 PowerTools 2008 that can freely be downloaded 
  56.   from Macecraft Software's official web site (www.macecraft.com).
  57.  
  58. "official distribution package" means a package file, such as .zip or
  59.   .rar archive or a self extracting ("SFX") version of such archive, or
  60.   an installation program containing jv16 PowerTools 2008 which can be
  61.   downloaded from Macecraft Software's official home page www.macecraft.com.
  62.  
  63. "license agreement" means this text document. This license agreement is a
  64.   legal agreement between you (individual or a legal entity) and
  65.   Macecraft Software. You must accept all the terms in this license 
  66.   agreement and the limitations of your current license if you want 
  67.   to use, run, copy or distribute jv16 PowerTools 2008 in any ways.

  69. "license" means a legal right to use jv16 PowerTools 2008. A license
  70.   must be bought before you are allowed to use jv16 PowerTools 2008 more than
  71.   its trial period of 30 days.

  73. "Amount of computers this product can be used with" means all kinds of use,
  74.   such as usage over a network connection or usage from a cd-rom or other
  75.   such media with or without actually installing the software to the specific
  76.   computer(s).

  79. 2. WARNING

  81. jv16 PowerTools 2008 is protected by copyright laws and international
  82. copyright treaties as well as other intellectual property laws and
  83. treaties. Unauthorized reproduction or distribution of the
  84. jv16 PowerTools 2008, or any portion of it, may result in severe criminal
  85. and civil penalties, and will be prosecuted to the maximum extent
  86. possible under law.

  90. 3. OWNERSHIP
  91.  
  92. jv16 PowerTools 2008 is proprietary to Macecraft Software.
  93. The product is licensed, not sold, to you
  94. notwithstanding any reference herein to "purchases".

  96. You acknowledge and agree that: 
  97. 1. jv16 PowerTools 2008 is protected by copyright laws and international
  98.    copyright treaties as well as other intellectual property laws and
  99.    treaties.
  100. 2. Macecraft Software and its licensors retain all copyrights 
  101.    and other intellectual property rights in the jv16 PowerTools 2008.
  102. 3. There are no implied licenses under this License, 
  103.    and any rights not expressly granted to you hereunder are 
  104.    reserved by Macecraft Software.
  105. 4. You acquire no ownership or other interest
  106.    (other than your license rights) in or to jv16 PowerTools 2008. 
  107. 5. Macecraft Software owns all copies of the jv16 PowerTools 2008, however made.

  111. 4. GRANT OF LICENSE
  112.  
  113. Macecraft Software is only willing to grant you these rights 
  114. if you obtained jv16 PowerTools 2008 from Macecraft Software or a 
  115. Macecraft Software authorized reseller. If you obtained jv16 PowerTools 2008 
  116. from any other source you may not install or use the jv16 PowerTools 2008.

  118. Macecraft Software grants you the following rights provided that you
  119. comply with all terms and conditions of this License Agreement:
  120.  
  121.   1. Usage. You may install, use, access and run jv16 PowerTools 2008
  122.      in so many computers that the license you own allows you to.

  124.      Note:
  125.      If you don't know with how many computers your current license 
  126.      allows you to use jv16 PowerTools 2008 you can find that out by starting
  127.      jv16 PowerTools 2008 and pressing the F12 key from your keyboard.

  130.   2. Personal usage. If you, or the company you work for, owns a License 
  131.      for jv16 PowerTools 2008 you may, in such case, install, use, 
  132.      access and run jv16 PowerTools 2008 in your home computer under the 
  133.      same license. In such case, your home computer must be owned and 
  134.      used only by you or the members of your family.
  135.  
  136.   3. Privacy. Macecraft Software hasn't implemented any mechanism, protocol,
  137.      method or algorithm ("Spyware") to jv16 PowerTools 2008 which would collect 
  138.      sensitive information from your computer and then would automatically 
  139.      send the information to Macecraft Software without your knowledge or 
  140.      permission.
  141.  
  142.   4. Basic security. Macecraft Software hasn't implemented any mechanism, 
  143.      protocol, method or algorithm ("Trojan Horse" / "Backdoor") which would allow
  144.      Macecraft Software to take full control of your computer without 
  145.      your knowledge or permission.

  147.   5. Re-sell this License. You have the right to sell your legal right to use
  148.      jv16 PowerTools to any third party at any price you wish. After such sale,
  149.      the legal right to use jv16 PowerTools will be fully and ultimately transfered
  150.      to the third party and you don't any longer have any legal right to the software
  151.      under the same License and therefore you must stop using the software under the
  152.      same License and destroy all possible copies you have of it and the License file
  153.      ("license.xbin"). You can re-sell one license only one time, after the sale your
  154.      legal right to use the software ends.

  158. 5. RESTRICTIONS AND LIMITATIONS OF USE

  160. You are NOT allowed to:

  162.   1. Modify, reverse engineer, decompile, disassemble or otherwise
  163.      attempt to reconstruct or discover the source code, or any parts
  164.      of it, or discover or reconstruct any mechanism, algorithm or
  165.      a protocol from the binaries of jv16 PowerTools 2008.
  166.  
  167.   2. Reverse engineer or otherwise attempt to reconstruct or 
  168.      discover the source code, or any parts of it, or discover 
  169.      or reconstruct any mechanism, algorithm or a protocol from 
  170.      the jv16 PowerTools 2008 by running any kind of special
  171.      monitoring software, such as registry monitoring software, 
  172.      or analysing software, such as "SoftICE" or other such tool.
  173.  
  174.   3. Use a program, source code, mechanism, method, protocol or
  175.      algorithm to bypass or to break jv16 PowerTools 2008' security
  176.      features, license validation, license creation routines, 
  177.      methods or algorithms, or any parts of them.
  178.  
  179.   4. Create derivative works based on jv16 PowerTools 2008 (e.g. incorporate
  180.      jv16 PowerTools 2008 in a commercial product or service without a proper
  181.      license), except that you may create translations of the program and its
  182.      help files.

  184.   5. Rent, lease, sublicense, convey, distribute or otherwise
  185.      transfer rights to jv16 PowerTools 2008 without a written permission
  186.      from Macecraft Software.

  188.   6. Remove any product identification, copyright, proprietary
  189.      notices or labels from jv16 PowerTools 2008.
  190.  
  191.   7. Distribute, re-distribute, rent, lease or sell the licensed
  192.      version of jv16 PowerTools 2008 or any portions of it or the license
  193.      itself, the "license.xbin" file, or any portions of the 
  194.      license or the "license.xbin" file without a written permission
  195.      from Macecraft Software.

  197.   8. Rent or lease jv16 PowerTools 2008, any portions of it 
  198.      or its license, or any portions  of a license without written
  199.      permission from Macecraft Software.
  200.  
  201.   9. Distribute jv16 PowerTools 2008 in any other form than in the
  202.      official distribution packages without a written permission
  203.      from Macecraft Software.
  204.  
  205.   10. Use the licensed version of jv16 PowerTools 2008 if you do not
  206.       have a valid license or if you do not know who has bought the 
  207.       license or if you know that the copy you are using is illegal 
  208.       or the license itself is illegal or faked.
  209.  
  210.   11. Use, run, copy, distribute or store jv16 PowerTools 2008 
  211.       in your computer if this license agreement is violated in any ways.

  215. 6. TERMINATION OF LICENSE
  216.  
  217. Macecraft Software has the right to terminate this license if you do
  218. not abide by the terms and conditions of this license, in which case 
  219. you must destroy all copies of jv16 PowerTools 2008 and all of its 
  220. component parts.

  223. 7. MAINTENANCE, SUPPORT AND UPDATES
  224.  
  225. Macecraft Software is under no obligation to maintain, support or
  226. update jv16 PowerTools 2008 in any ways, or to provide updates or error
  227. corrections.

  229. However, if you have purchased technical support from Macecraft Software
  230. for this product will Macecraft Software then provide technical assistance 
  231. according to the terms of the contract.

  233.  
  234. 8. CONFIDENTIALITY
  235.  
  236. Licensed version of jv16 PowerTools 2008 and any license authorization
  237. codes (such as the "license.dat" file) are confidential. You agree to take
  238. adequate steps to protect jv16 PowerTools 2008 and any license authorization
  239. codes and "license.dat" file from unauthorized disclosure or use.
  240. You agree that you will not disclose the licensed version of
  241. jv16 PowerTools 2008, any parts of it, its license or any parts of the
  242. license to any third party.

  245. 9. DISCLAIMER
  246.  
  247. Macecraft Software expressly disclaims all warranties, whether express, 
  248. implied or statutory, including, without limitation, the implied 
  249. warranties of merchantability, of fitness for a particular purpose, 
  250. noninfringement of third party intellectual property rights, and any 
  251. warranty that may arise by reason of trade usage, custom, or course of 
  252. dealing. Without limiting the foregoing, you acknowledge that 
  253. jv16 PowerTools 2008 is provided "as is" and that Macecraft Software 
  254. does not warrant that jv16 PowerTools 2008 will run uninterrupted or error 
  255. free nor that jv16 PowerTools 2008 will operate with hardware and/or 
  256. software not provided by Macecraft Software. This disclaimer
  257. of warranty constitutes an essential part of the agreement. Some states
  258. do not allow the exclusion of implied  warranties, so the above exclusion
  259. may not apply to you, and you may have other rights, which vary from
  260. state to state.

  263. 10. LIMITED LIABILITY
  264.  
  265. The entire risk as to results and performance of jv16 PowerTools 2008 is assumed
  266. by you. Under no circumstances will Macecraft Software or they licensors be liable
  267. for any direct or special, indirect, incidental, exemplary or consequential
  268. damages of any kind or nature whatsoever, whether based on contract,
  269. warranty, tort (including negligence), strict liability or otherwise,
  270. arising out of or in any way related to jv16 PowerTools 2008 or this agreement,
  271. even if the Author or his licensors have been advised of the possibility
  272. of such damage or if such damage could have been reasonably foreseen,
  273. and notwithstanding any failure of essential purpose of any exclusive
  274. remedy provided in this agreement. Such limitation on damages includes,
  275. but is not limited to, damages for loss of goodwill, lost profits, loss
  276. of data or software, work stoppage, computer failure or malfunction or
  277. impairment of other goods. In no event will the Author or his licensors
  278. be liable for the costs of procurement of substitute Software or services.
  279. in addition, in no event will the total liability of the Author in connection
  280. with this agreement or jv16 PowerTools 2008 exceed the actual amount paid to the
  281. author, if any, for jv16 PowerTools 2008 giving rise to the claim. You acknowledge
  282. that jv16 PowerTools 2008 is not designed or licensed for use in on-line equipment
  283. in hazardous environments such as operation of nuclear facilities, aircraft
  284. navigation or control, or life-critical applications. The Author expressly
  285. disclaims any liability resulting from use of jv16 PowerTools 2008 in any such
  286. on-line equipment in hazardous environments and accepts no liability in
  287. respect of any actions or claims based on the use of jv16 PowerTools 2008 in any
  288. such on-line equipment in hazardous environments by you. For purposes of
  289. this paragraph, the term "life-critical application" means an application
  290. in which the functioning or malfunctioning of jv16 PowerTools 2008 may result directly
  291. or indirectly in physical injury or loss of human life.

  294. 11. DISTRIBUTING

  296. Trial version of jv16 PowerTools 2008 may be freely distributed provided
  297. that it is not modified in any ways and that the original distribution packages
  298. remain intact with all accompanying files, and provided that no fee is
  299. charged (except for any reasonable fees necessary to cover costs of
  300. distribution media), and that this license agreement is not violated
  301. in any ways. You are not allowed to include jv16 PowerTools 2008 to any
  302. commercial CD-ROM or DVD software collection without a written permission
  303. from Macecraft Software.
  304. Macecraft Software reserves the right to deny you from distributing
  305. jv16 PowerTools 2008 even if you haven't violated this license agreement.

  308. 12. RESERVATION OF RIGHTS
  309.  
  310. Macecraft Software reserves all rights not expressly granted to you 
  311. in this license agreement.
